Terms of Use

These Terms of Use ("Terms") form a legally binding agreement between you and Batuhan Bayır, doing business as Orbit ("Orbit," "we," "us," or "our"), governing your access to and use of the Orbit iOS application, Share Extension, joinorbit.web.app website, and related services (collectively, the "Services").
By downloading, creating an account, purchasing a subscription, or otherwise using the Services, you confirm that you have read and agree to these Terms and the Privacy Policy. If you do not agree, do not use Orbit.
Important safety notice
Orbit produces approximate, automated crossing suggestions. A crossing is not proof that two people met, saw one another, or were at a particular address. Orbit is not an emergency service, personal-safety system, surveillance tool, or substitute for your own judgment. Never use Orbit to stalk, track, threaten, or pressure another person.

If you download Orbit from Apple's App Store, Apple's Standard Licensed Application End User License Agreement ("Apple EULA") also applies. These Terms govern Orbit's account, social, location, content, support, and subscription services and supplement the Apple EULA. If a conflict exists, applicable App Store terms and mandatory consumer law control to the extent required.
This agreement is between you and Orbit, not Apple. Apple is not responsible for the Services or their content, maintenance, support, warranties, or claims, except as required under the Apple EULA. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce applicable App Store provisions.
2. Eligibility
You must be at least 18 years old and legally able to enter a binding agreement to use Orbit. By using the Services, you represent that you satisfy these requirements, are not prohibited from using the Services under applicable law, and will provide accurate account information. Orbit is not intended for minors.
3. Account responsibilities
You create an account through Sign in with Apple or Google Sign-In. You are responsible for safeguarding your device and provider account, keeping your profile information reasonably accurate, and all activity performed through your account. You may not sell, transfer, automate, or share access to your Orbit account; impersonate another person; create a misleading identity; or create accounts to evade a restriction.
Contact bbayir686@gmail.com promptly if you suspect unauthorized access. We may ask you to verify account control before assisting with sensitive requests.
4. The Orbit service
Orbit may offer location-based crossings, approximate shared-place memories, a private route map, Gallery Map, Apple Music shares and music matching, user search, waves, mutual connections, invites, shared galleries, notifications, blocking and reporting tools, profile customization, and Orbit Premium access.
Some features require an account, an active subscription, a compatible iPhone and iOS version, internet access, background services, or optional permissions. Features may vary by device, country, App Store availability, permission state, subscription status, and app version.
4.1 Location and crossing results
Visit crossings are based on approximate location cells and timestamps within a one-hour window. The ten-minute time slot used internally is a search index, not a promise that two people were together for ten minutes. Music shares may create or enrich a physical crossing when compatible song or artist data is location-stamped, the shares are within one kilometre and one hour, and other safeguards are satisfied.
Location and photo metadata can be unavailable, delayed, stale, approximate, or wrong. Orbit may merge repeated signals, suppress unusually crowded candidate windows, and revise matching logic. We do not guarantee that every real-world crossing will appear or that every displayed crossing is correct.
4.2 No identity or relationship guarantee
Orbit does not independently verify every user's identity, intentions, background, statements, social links, age declaration, or content. A username, profile, crossing, wave, friend status, or shared memory does not mean Orbit endorses or has vetted that person. You decide whether and how to interact.
4.3 Service changes and availability
We may add, change, limit, suspend, or discontinue features to improve safety, reliability, legal compliance, or the product. We aim to preserve paid access for the active billing period, subject to security, legal, technical, and platform requirements and mandatory consumer rights. We do not guarantee uninterrupted or error-free availability.
5. Safety and acceptable use
Zero tolerance. Orbit has zero tolerance for objectionable content and abusive users. Photos are automatically screened when uploaded, and content that is pornographic, nude, sexually explicit, or otherwise objectionable is removed. Content that is reported or detected is reviewed, offending content is removed, and offending users may be ejected, typically within 24 hours.
You must use Orbit lawfully, respectfully, and only for its intended personal, non-commercial purpose. You must not:
- harass, threaten, stalk, intimidate, shame, exploit, or abuse another person;
- use crossing, photo, music, location, or social information to infer, expose, or publish someone's home, workplace, routine, identity, or sensitive activities;
- pressure someone to connect, meet, share a photo, disclose information, or continue communicating;
- impersonate anyone, misrepresent your identity or age, create deceptive profiles, or submit knowingly false reports;
- upload or share content that is illegal, sexually exploitative, hateful, violent, defamatory, invasive of privacy, or infringes intellectual-property or publicity rights;
- share a photo of another person without having the rights and permissions required by law;
- scrape, crawl, index, harvest, export, or commercially exploit users, profiles, locations, photos, music metadata, databases, or Services;
- use bots, scripts, automated accounts, load tests, or unauthorized interfaces;
- reverse engineer, decompile, disassemble, copy, modify, bypass, or interfere with Orbit, App Check, authentication, subscriptions, rate limits, access controls, or matching safeguards, except where law expressly permits;
- introduce malware, probe vulnerabilities without written authorization, gain unauthorized access, disrupt infrastructure, or help another person do so;
- use Orbit for surveillance, law-enforcement activity without lawful authority, advertising, discrimination, eligibility decisions, or any high-risk purpose; or
- violate applicable law, these Terms, another person's rights, or App Store rules.
If you feel unsafe, stop interacting, use Orbit's block or report controls, and contact local emergency services where appropriate. Orbit cannot provide emergency assistance.
6. Your content and permissions
6.1 Ownership and responsibility
You retain any ownership rights you have in profile text, social links, photos, feedback, and other content you submit ("User Content"). You are solely responsible for User Content and represent that you have all rights, consents, and permissions necessary to submit it and allow the uses described here.
6.2 Limited licence to operate Orbit
You grant Orbit a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, resize, transmit, and display User Content solely as reasonably necessary to provide, secure, moderate, and support the Services. For example, this permits Orbit to store your profile cutout, show public-profile fields to signed-in users, and show an explicitly shared photo to the eligible mutual connection.
This licence ends when the content or account is deleted, except to the extent a temporary backup, legal requirement, safety investigation, or enforceable claim requires limited continued retention. Deleting a local photo from Apple Photos does not automatically delete a copy you previously shared to Orbit; remove the Orbit share separately.
6.3 Public and shared content
Public-profile fields and social links can be seen by signed-in users as described in the Privacy Policy. Content deliberately shared into a mutual Gallery Map can be seen by the involved crossing participants. Other users may capture screenshots or retain information outside Orbit, which we cannot fully control.
6.4 Music and third-party material
Song names, artist names, album information, artwork, Apple Music links, and other third-party material remain owned by their respective rights holders. Orbit's display of metadata does not transfer ownership to you or Orbit. You must follow the applicable Apple and content-provider terms.
6.5 Feedback
If you voluntarily send ideas or feedback, you grant us a perpetual, worldwide, non-exclusive, royalty-free right to use it to operate and improve Orbit without compensation or obligation, provided we do not publicly identify you without permission.
7. Orbit's intellectual property and licence
Orbit and its licensors own the Services, including software, source and object code, designs, artwork, branding, text, layouts, animations, algorithms, matching logic, databases, compilations, and documentation, excluding User Content and third-party material.
Subject to these Terms and the Apple EULA, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use Orbit on Apple-branded devices you own or control, solely for lawful, personal, non-commercial use. No other rights are granted. Orbit and its branding may not be used in a way that suggests sponsorship or endorsement without written permission.
8. Orbit Premium, billing, cancellation, and refunds
Orbit requires an active auto-renewing Orbit Premium subscription for app access after onboarding. Available weekly or annual products, included features, price, currency, taxes, and billing period are displayed in the App Store purchase sheet before confirmation.
- Payment is charged to your Apple ID when you confirm the purchase.
- The subscription renews automatically unless you turn off auto-renewal at least 24 hours before the current period ends.
- Apple may charge your account for renewal within 24 hours before the current period ends.
- You can manage or cancel at iOS Settings → [your name] → Subscriptions or at Apple's subscription page.
- Deleting Orbit or your Orbit account does not automatically cancel the Apple subscription. Cancel it separately through Apple.
- Use Restore Purchases where offered to ask Apple to restore an eligible entitlement associated with your Apple ID.
- Orbit does not receive your payment-card details and cannot directly issue App Store refunds. Refund eligibility and processing are governed by Apple and mandatory consumer law. You may request an App Store refund through reportaproblem.apple.com.
Prices and plans may change for future purchases or renewal periods through Apple's procedures. Orbit Premium currently includes no free trial. Any future promotional access would apply only if it is expressly displayed in the App Store purchase sheet before confirmation.
9. Third-party services and links
Orbit relies on services supplied by Apple, RevenueCat, Google Firebase, and Google Sign-In and may open user-provided social links. Third-party services are governed by their own terms and privacy notices. We are not responsible for their availability, content, security, or conduct, although non-waivable rights remain unaffected.
You must comply with applicable third-party terms, including the Apple Media Services Terms, App Store rules, and authentication-provider terms. Orbit is not affiliated with or endorsed by a social platform merely because a user posts a link to it.
10. Reports, blocking, suspension, and account deletion
Orbit provides tools to remove a connection, block a user, and report conduct. We may review available information and take action we reasonably consider appropriate, including warning, restricting, suspending, or terminating an account; removing content; preserving evidence; or contacting authorities. We are not required to disclose confidential moderation details, and submitting a report does not guarantee a specific outcome.
We may suspend or terminate access where we reasonably believe there is a Terms violation, safety risk, fraud, legal requirement, security threat, charge abuse, or harm to Orbit, another user, or a third party. Where practical and legally permitted, we may provide notice or an opportunity to appeal by email.
You may delete your account from Profile → Settings → Delete account. Account deletion is irreversible and removes Orbit data as described in the Privacy Policy, subject to limited legal, safety, transaction, log, and backup retention. It does not cancel your Apple subscription.
Provisions that by their nature should survive termination—including intellectual property, licences already needed for lawful retention, disclaimers, liability limits, dispute terms, and unpaid obligations—will survive.
11. Disclaimers, assumption of risk, and liability
11.1 “As is” service
To the maximum extent permitted by law, Orbit is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, security, and quiet enjoyment. We do not warrant that Orbit will be uninterrupted, error-free, free of harmful components, or compatible with every device or configuration.
11.2 Location and user-interaction risk
You assume the risks of relying on approximate crossings, user profiles, social links, shared content, and interactions online or offline. Orbit does not guarantee a match, friendship, relationship, safe meeting, identity, location, or outcome. Take reasonable precautions, meet in public when appropriate, tell someone you trust, and do not share sensitive information prematurely.
11.3 Limitation of liability
To the maximum extent permitted by law, Orbit and its owner, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, revenue, opportunity, reputation, or goodwill; personal interactions; unauthorized user conduct; inaccurate crossings; service interruption; or inability to use the Services, even if advised that such damages were possible.
Where liability cannot be excluded, our aggregate liability arising from the Services will not exceed the greater of the amount you paid to Orbit through the App Store during the 12 months before the event giving rise to the claim or USD 50, except where mandatory law requires a different remedy or limit. Nothing in these Terms excludes liability that cannot lawfully be excluded, including applicable consumer rights or liability for intent, gross negligence, or personal injury where law so provides.
11.4 Indemnity
To the extent permitted by law, you agree to indemnify Orbit against third-party claims, losses, and reasonable costs arising from your unlawful User Content, violation of another person's rights, misuse of the Services, or material breach of these Terms. This provision does not apply to the extent a claim was caused by Orbit or where consumer law prohibits it.
12. Governing law, disputes, and general terms
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. Subject to mandatory consumer jurisdiction, disputes will be submitted to the competent courts and enforcement offices of Bursa, Türkiye. If you live in the European Economic Area, United Kingdom, or another jurisdiction with mandatory consumer protections, you retain the protections and courts available under that law.
Before filing a claim, we encourage you to email bbayir686@gmail.com with a description of the issue so we can try to resolve it informally. This does not prevent you from contacting a consumer authority or exercising a right that cannot be waived.
If any provision is held invalid or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, merger, acquisition, or asset transfer, subject to applicable law. These Terms, the Privacy Policy, and incorporated App Store terms constitute the agreement concerning the Services.
13. Changes and contact
We may update these Terms as Orbit changes. The revised date will appear above. For material changes, we may provide notice in the app, on the website, or by email where appropriate. Changes apply prospectively when posted or on the stated effective date. If you do not agree to revised Terms, stop using Orbit and delete your account.
